Terms and Conditions of Use

1. Operator Identification

The website www.giaconnect.com (hereinafter referred to as \\\\\\\"the Platform\\\\\\\") is owned and managed by:

• User: Any person accessing the Platform.
• Owner (Partner): Natural or legal person registering their accommodation unit on the Platform for promotion.
• Tourist (Client): Person using the Platform to search for and book accommodation units.
• Service: The online intermediation and promotion service offered by LAVALI ONLINE SHOP SRL.
• DSA: Regulation (EU) 2022/2065 on digital services (Digital Services Act).

3. Contract Object and Platform Role

3.1. giaconnect.com acts as a promotion portal and a technological intermediary between Owners and Tourists.

3.2. LAVALI ONLINE SHOP SRL does not own the accommodation units displayed on the site and is not a contractual party in the actual accommodation process. The accommodation contract is concluded exclusively between the Owner and the Tourist.

3.3. The Platform assumes no responsibility for the accuracy of the information provided by owners (photos, facilities, prices), although we make constant efforts to moderate the content.

3.4. In accordance with the DSA, the single point of contact for communication with Member State authorities, the Commission, and the Board is contact@giaconnect.com. Communication can be conducted in Romanian and English.

4. Conditions for Owners (Hoteliers)

4.1. Registration: The Owner declares on their own responsibility that they possess all legal authorizations (including Classification Certificate from the Ministry of Tourism) to operate.

4.2. Trial Period: Upon registration, Owners benefit from a free 7-day trial period. After this period expires, unit visibility will be automatically suspended if a subscription is not purchased.

4.3. Subscriptions and Payments:

• Continuous promotion on the site is based on a paid subscription (Monthly/Annual).
• Payment is made by bank transfer to the account specified in Art. 1.
• Subscription activation occurs after payment confirmation.
• LAVALI ONLINE SHOP SRL will issue the fiscal invoice for the promotion services rendered.

4.4. The Owner has the obligation to update the availability calendar. Repeated refusal of confirmed bookings may lead to exclusion from the Platform.

5. Conditions for Tourists (Bookings)

5.1. The Platform allows sending booking requests. A booking is considered firm only after its confirmation by the Owner.

5.2. Booking Cancellation: The cancellation and deposit refund policy is established by each unit individually. Please check the specific conditions of each unit before booking.

5.3. The User undertakes to provide real contact data. Bookings made with false data will be cancelled.

5.4. Reviews: The Platform displays reviews posted by users. GIAConnect.com does not guarantee that users who posted reviews have actually used or purchased the services, except where the review is marked as \\\\\\\"Booking confirmed via platform\\\\\\\".

6. Limitation of Liability

6.1. LAVALI ONLINE SHOP SRL cannot be held liable for:

• Differences between photos on the site and the reality at the location.
• The behavior of owners or tourists.
• Cancellation of bookings by owners due to objective reasons or force majeure.
• Inconveniences caused by temporary interruptions of site operation.

7. Intellectual Property

7.1. The site content (logo, source code, graphics, structure) is the exclusive property of LAVALI ONLINE SHOP SRL.

7.2. Owners grant the Platform a non-exclusive license to use the uploaded photos and descriptions for promotion purposes (including on GIA Connect social media).

8. Data Processing (GDPR)

8.1. Personal data is processed according to Regulation (EU) 2016/679. Full details are available on the page Privacy Policy.

9. Litigation and Final Provisions

9.1. The Terms and Conditions are governed by Romanian law.

9.2. Any dispute shall be settled amicably. Otherwise, competence belongs to the courts at the LAVALI ONLINE SHOP SRL headquarters.

9.3. For online dispute resolution, you can access the ODR platform managed by the European Commission at: https://ec.europa.eu/consumers/odr.

9.4. The Platform reserves the right to modify these terms, notifying users by displaying the last update date.
